1. General
These Terms and Conditions apply to all agreements, offers, and services provided by Canal Enterprise B.V., operating under the name Club Amstel, registered in the Netherlands under Chamber of Commerce number 98673718, hereinafter referred to as 'Club Amstel'.
By making a booking or entering into an agreement with Club Amstel, the client agrees to these Terms and Conditions.
2. Services
Club Amstel offers private boat tours on the Amsterdam canals and the Amstel river aboard a classic saloon boat, with a maximum capacity of 52 persons (seating approximately 25). Services include, but are not limited to:
- Sunset cruises
- Classic canal tours
- Amstel river tours
- Drinks (borrel) cruises
- Business Club memberships
Every tour is operated by a certified, professional skipper. The vessel holds a valid permit for the Amsterdam canals.
3. Booking & Confirmation
Bookings can be made via the Club Amstel website (www.clubamstel.com), by email (info@clubamstel.com), or by telephone (+31 6 29 03 97 01).
A booking is only confirmed after written confirmation by Club Amstel. Club Amstel reserves the right to refuse bookings.
Bookings are subject to availability. Club Amstel recommends booking as far in advance as possible.
Excluded dates: bookings (including hours under a Business Club membership) cannot be used on King's Day (Koningsdag), Amsterdam Gay Pride, and Sail Amsterdam. The vessel is not available for regular bookings on these dates. Club Amstel will inform members of the exact dates in good time.
4. Pricing
All prices are in euros and exclusive of VAT (BTW) unless stated otherwise. The standard charter rate is €250 per hour (excl. VAT), with a minimum booking duration of 2 hours.
Tourist tax (€2.70 per person per tour) is charged separately. Drinks, catering, and additional services are charged separately unless explicitly included in the agreement.
If guests bring their own drinks, a service charge of €7.50 per person per hour applies.
Prices for the Business Club memberships are as set out in the separate Membership Agreement.
5. Payment
Invoices are sent by email. Standard payment terms are 7 days from invoice date, unless agreed otherwise in writing.
In the event of late payment, Club Amstel reserves the right to suspend services and to charge statutory interest and collection costs.
6. Cancellation & Rescheduling
6.1 Cancellation by the client
The following cancellation policy applies:
- More than 48 hours before departure: no charge
- Between 24 and 48 hours before departure: 50% of the booked amount
- Less than 24 hours before departure: 100% of the booked amount
6.2 Weather cancellation
In the event of persistent rain, extreme wind, storm, or a KNMI weather warning code orange or red, the tour may be cancelled without charge. Cancellation due to weather must be communicated no later than 2 hours before departure.
In the event of bad weather, Club Amstel will offer an alternative date at no extra cost.
6.3 Cancellation by Club Amstel
Club Amstel reserves the right to cancel a tour due to force majeure (including technical failure or unsafe weather conditions). In such cases, no charges apply and an alternative date will be offered.
7. Safety & House Rules
All guests are required to follow the instructions of the skipper at all times. The skipper has final authority on board.
- Life jackets are available for all 52 persons on board
- Swimming, climbing on the roof, or any behaviour endangering safety is prohibited
- The maximum permitted capacity of 52 persons must not be exceeded
- Guests are responsible for their own behaviour and that of their group
Canal Enterprise B.V. / Club Amstel accepts no liability for damage, injury, or loss arising from non-compliance with the house rules or instructions of the skipper.
8. Liability
Club Amstel's liability is limited to the amount invoiced for the relevant booking. Club Amstel is not liable for indirect damage, consequential damage, or loss of profit.
Club Amstel is not liable for theft, loss, or damage to personal belongings of guests on board.
The client is liable for any damage caused to the vessel, equipment, or third parties by the client or their guests.
9. Privacy
Canal Enterprise B.V. processes personal data in accordance with the General Data Protection Regulation (GDPR) and the Dutch Implementation Act (UAVG). For further details, please refer to our Privacy Policy available at www.clubamstel.com/privacy.
10. Applicable Law & Disputes
These Terms and Conditions are governed by Dutch law. Disputes shall preferably be resolved by mutual agreement. If this is not possible, disputes will be submitted to the competent court in Amsterdam.
11. Amendments
Club Amstel reserves the right to amend these Terms and Conditions. The most current version is always available at www.clubamstel.com. Amendments take effect 14 days after publication.
